What is Trade License

Every business organization needs a trade license from regulators, be it the municipal corporation or the state government. Trade License is a document that gives permission and certifies you to carry on a particular trade or business for which it is issued. It does not give ownership of property or permission for any other activity other than for which it is issued.
The municipal corporation authorizes license department and allots licenses in consultation with other specific consultative departments like Health, Engineering, Estate and others of the same type.
In perspective of this, it is essential for any business establishments to take primary licenses from the License Department before beginning manufacturing, exchange or storage of any activity. The application has to be filed with the Commissioner in the Corporation 30 days before the start of business. While filing, the business has to submit all the mandatory documents.

Documents Required for Trade Licence

Colour Photograph, Pan card and ID Proof and Address Proof of all Directors/ Partners. Front-Facia Photograph of the establishment with Display of goods traded from the premises.
Canceled Cheque and bank statement of the establishment.
Site/Key Plan Showing the area under the occupation of the applicant earmarking the neighbourhood of the site.
Pan Card of the establishment in case of company, LLP or Firm.
Certificate of Incorporation, MOA and AOA of the company or LLP/ Partnership Agreement as the case may be.
Premises Proof of the establishment in the form of Sale Deed, Electricity Bill/water bill and NOC from owner.

Licensing Authority for Trade License

Trade License(s) are issued by the authorised department of a municipal corporation in consultation with other specialised departments like fire brigade, health, engineering department having jurisdiction over the business.

Commercial Premises

Trade License can be availed only if the business is run in the Permitted area. I.e. a Commercial, Local commercial, Notified Commercial, Mixed Land Use or Residential area with small shops of maximum 20 sq.m. on ground floor only.

Every trader engaged in a general trading activity within the territorial limits of any municipal corporation is required to obtain a trade license. The class of trade license differs from state to state and is based on the nature of the business.

Types of Trade License

Shop License

This license is required for anyone who wants to open a shop. The shop can be of any retail type.

This type of license is required for any company that wants to open a small or mid-sized industrial unit.

Food Establishment License

Any establishment that plans on getting into the food and beverage industry requires this license. The license applies to restaurants, cafes, meat shops, bakeries and vegetable shops.

A trade license is a document or certificate that permits the applicant to start a particular trade or business in a particular area/location. Furthermore, this license does not pass on any sort of property ownership to the holder of the license.

The municipal authority of the particular state is the accountable body for the issuance of the trade license.

Every trader involved in a general trading activity within the national limits of any municipal corporation is needed to get a trade license. The class of trade license varies from state to state and is based on the nature of the business.

The process to obtain Trade licence are:
1. Application in Form 353 or 354, depends on the case.
2. If the applicant is a person, his/her Aadhaar Card is necessary.
3. If the applicant is any Company, LLP, Firm, etc, the PAN Card and incorporation certificate or document.
4. Latest Tax Payment Receipt.
5. Consent letter or Lease documents from the Owner of the property.

The documents required for Trade License are:
• Lease documents/agreement in case of premises are on lease
• Occupation certificate
• ID proof of applicant (for individual it is Aadhaar card and for company, it is PAN card & certificate of incorporation)
• Registration certificate from concerned authority

It typically takes 8 days. In case, documents are incomplete and erroneous, it may take more time

If the license is denied by the commission, then you may appeal to standing committee by delivering the denied letter.

According to the Act, running an unapproved Trade is an offense. The concerned authorities may seize or lock your Trade business with or without prior intimation.
